Did Jack Smith Indict the Wrong Guy?

I haven’t read the entire revised indictment which Jack Smith has submitted to the District Court in response to the Supreme Court’s decision that the indictment cannot charge Trump with crimes if he was carrying out official, Presidential duties, but I have read enough to believe that the new indictment is, if anything, stronger than the indictment it has replaced.

To begin, the original indictment ran 45 pages, the revised indictment runs 165 pages. More important, perhaps, is that the revised indictment focuses on Trump’s behavior based on how he interacted with members of his campaign staff and other private individuals, whereas the original indictment opens with Trump ordering members of both his Executive Office staff along with staff from other Federal agencies to conduct various activities to validate the idea of election ‘fraud’ on his behalf.

Thus, the original indictment opens with a statement that Trump led a conspiracy to “impair, obstruct and defeat the federal government function through dishonesty, fraud and deceit,” and then immediately describes attempts by Trump to enlist staff from both the Department of Justice and the Department of Homeland Security to aid him in this illegal fight.

The revised indictment, on the other hand, opens with this statement: “At its core, the defendant’s scheme was a private…
